Reservation Fee
1. Definitions
In these terms, unless the context requires otherwise, the following definitions apply:
- “Appointment” means the appointment to view the Vehicle in accordance with Clause 7.
- “WMA”means the motor vehicle dealership WMA Vehicle Hire & Sales Ltd.
- “Customer” means an individual who wishes to inspect a Vehicle at the WMA dealership or online at wmamotors.co.uk.
- “Reservation”means the process by which a Vehicle is reserved at a retail Customer’s request in accordance with these terms and conditions.
- “Order Form” means the standard form/invoice used by the WMA dealership.
- “Purchase” means the entering into a contract by the completion and signing of an Order Form.
- “Reservation Fee” means the sum payable by a Customer in respect of a Vehicle.
- “Vehicle” means the passenger car (being a car intended for the carriage of passengers) and light commercial vehicles (such as small vans and pick-up trucks) that a Customer wishes to reserve.
- “Working Day” means any day except Saturday, Sunday or any bank or customary public or statutory holiday in England and Wales.
- These are the terms and conditions that apply to the exclusion of all others (including any verbal statement or representation) in respect of the Reservation Fee.
- Reservation is available to Vehicles advertised on wmamotors.co.uk where the Vehicle is advertised with the Reservation Fee.
- A Reservation Fee can only be paid online via bank transfer, or by visiting the WMA dealership.
- To secure a Vehicle reservation, the Reservation Fee must be paid in the name of the Customer. The Customer must also provide their:
- name
- full postal address
- telephone number
- email address
- chosen method of contact
- Once the Reservation Fee is confirmed as paid, WMA will reserve the Vehicle at the WMA dealership for 48 hours, unless extended under Clause 7.
- Within 48 hours of the Reservation being confirmed as being paid, the Customer must make an Appointment to view the Vehicle, or arrange delivery/collection (the remaining balance to be paid in full prior to this). An Appointment shall be either by:
- attending the WMA dealership to view the Vehicle; or
- walk-around videos can be supplied if unable to attend the dealership.
- Where a Customer attends the WMA dealership, or decides to Purchase the Vehicle online, the Reservation Fee will be applied to the purchase price of that Vehicle as shown on the Order Form.
- Where a Customer attends an Appointment or notifies WMA, on the day of the Appointment, that they do not want to Purchase the Vehicle, the Reservation Fee will be refunded by way of credit via the original payment method used, in accordance with Clause 5, within five Working Days.
- Where a Customer does not comply with the requirements of Clauses 7 or 9, the Reservation is forfeit and will not be refunded.
- Should a Customer wish to terminate the sale, at any stage following the completion of the contract of sale, the Reservation Fee is non-refundable.
- Customers may only make one Reservation at any one time.
- The Reservation Fee is not a deposit, and shall not constitute a contract for the sale or purchase of the Vehicle.
- A person who is not a party to the terms herein shall not have any rights under or in connection with it and the provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded.
- These terms and conditions are governed by the laws of England and Wales.
- The Parties submit to the exclusive jurisdiction of the English Courts.
- Nothing in these terms and conditions will affect or limit the statutory rights of a consumer.

Complaints procedure
If you are unhappy with any aspect of our service, we want to hear from you and put things right. Our complaints process works as follows:
- Tell us. Contact us by phone on 01670 531777 or email at [email protected] with details of your complaint. We will acknowledge your complaint within 3 working days.
- We investigate. We will look into your complaint thoroughly and aim to provide a final response within 8 weeks. If we need more time, we will explain why and keep you updated.
- Final response. We will write to you with our findings and, where appropriate, any offer of redress.
Financial Ombudsman Service
If your complaint relates to a regulated financial product (such as a finance agreement arranged through us as a credit broker) and you are not satisfied with our final response, or if 8 weeks have passed since you first complained, you may refer your complaint to the Financial Ombudsman Service (FOS). This is a free, independent service for resolving disputes.
For complaints not related to regulated financial products (such as vehicle sales or rentals), you may also contact your local Trading Standards office via the Citizens Advice Consumer Service on 0808 223 1133.
Governing law
These terms and conditions are governed by the laws of England and Wales. The parties submit to the exclusive jurisdiction of the English Courts. Nothing in these terms and conditions will affect or limit the statutory rights of a consumer.
